Copyright registration does not grant rights, as the author of a creative work automatically holds them (moral and economic rights) by the mere fact of creation (Berne Convention). However, registering before sharing or publishing the work is essential to establish a "prima facie" evidence of authorship and to possess the strongest possible time-stamped proof against potential infringers.

Note on Coexistence: Digital registration with Safe Creative is not incompatible with evidence obtained from traditional in-person registries; however, it provides a superior layer of technical evidence suited for today’s global environment.

Both registrations: Provide valid proof of presumed authorship, which allows for contrary evidence.

Neither registration: Is mandatory or grants authorship rights, as the author acquires those rights simply by creating the work.

The evidence provided by both is based on the date on which the work was already in the author's possession and the responsible authorship declaration was registered; therefore, the greatest protection is achieved by registering the work before disclosing it, in order to have the strongest time-stamped proof.

The difference between the two lies in the nature of the proof they provide to the author.

• The official registration of a country provides a signed document as proof. As it has official status in its country, it is admitted as evidence, and the veracity of its content is presumed.
• Safe Creative provides as proof a file with a double timestamp to guarantee the date of registration, which contains the work together with three cryptographic fingerprints of the work to confirm that it is the registered work and that it has not been altered since registration. Additionally, this information is recorded daily in an audit trail on the Ethereum blockchain.
• The certificate of an official registry has evidentiary character in its own country because it is an official document. To use it in processes in other countries, it is necessary to apostille the certificate and ensure that the country where it is going to be used admits the Hague Apostille.
• The Safe Creative certificate, due to its technical nature, has international validity as it is independent of the administrative scope of the country where it has been generated.

Important: Not all countries offer an intellectual property registration service. These differences refer specifically to authorship registrations, not to other types of administrative filings that may be offered by some local registries.

Any kind of work, document of file can be registered at Safe Creative, however you must be aware that not all works are protected by copyright laws. According to the World International Property Organization’s Berne Convention for the Protection of Literary and Artistic Works copyright include:

Literary works: articles, tales, novels, essays, posts, electronic pages, etc.

Dramatic and audiovisual works: movies, animations, theater, short films, etc.

Musical works: musical compositions, phonographic productions, scores, etc.

Artistic works: drawings, paintings, designs, three-dimensional models, sculpture, engravings,
lithographies, comics, photography, etc.

Databases and software (in some legislations): the code (whatever format) and their manuals and related technical documents, graphics and description modules.

Can we register brands, inventions, trade names, ideas, projects, methods, etc.?

Trademarks are not artistic, literary or scientific creations (works protected by copyright), but words, symbols, devices or names used for commercial purposes.

To obtain a trademark or a trade name, an administrative procedure must be followed through an official body and the corresponding fee must be paid, similar to what must be done to register a patent, and it is granted for a limited period of time. Safe Creative is not a site to register social, economic, festivals, learning methods, concepts, events, etc. projects. Those would be considered ideas by themselves and are excluded to generate copyrights by local copyright laws and international agreements.

When we talk about “projects” in authorship rights contexts, we are talking about, for instance, buildings’ blueprints. Read more.

The technological proof generated upon registration is permanently valid. The redundant combination of three different cryptographic technologies (SHA1, SHA256, and SHA512) for the identification of the work, and two timestamps inscribed in turn on the Ethereum blockchain, guarantees its proof validity over time.

Once a work has been registered, you can download the proof of registration, which you can always use as proof of authorship and other registered rights, regardless of whether you continue as a Safe Creative user or not.

Safe Stamper is a service that electronically certifies the existence of digital information at a specific moment in time. It acts as a digital notary, generating legally valid evidence that proves a piece of content existed exactly as it was on a given date and time.

With Safe Stamper, you can certify virtually any type of digital evidence, including:

• Certifying the content of a web page (URL, date, and time of access).

• Certifying the sending, content, and recipients of emails (including attachments).

• Certifying that a digital file (document, image, etc.) existed on a specific date, through timestamping and cryptographic hashes.

• Certifying photos, videos, or audio recordings with geolocation data (date, time, location) using the mobile app.

• Legally valid advanced electronic signatures.

Safe Stamper certifications have international legal validity, in compliance with regulations such as the European Union’s eIDAS Regulation. They can be used as evidence before authorities, courts, and both public and private entities.

Both services are complementary: Safe Creative protects authorship, and Safe Stamper certifies digital facts or related evidence.

What is Creators and how does it work?

Creators is the dedicated space for artists on Safe Creative, where you can get known, promote your portfolio, connect with your followers, showcase your art, sell your digital works, or offer professional services.

Plus, you have the chance to win prizes!

You decide which registered works you want to exhibit. For those you put up for sale, you can set a price and define the usage rights the buyer will acquire. Alternatively, you can allow the buyer to propose a budget, specifying the rights to the work they wish to acquire.

How to activate my Creators profile?

If you have an active subscription on Safe Creative, you can open your space on Creators by following these steps:

1. Go to the upper right corner, click on LOGIN, and sign in with your Safe Creative username and password.
2. Once logged into your profile, click on your name in the upper right corner and go to “Edit Profile”.
3. In this section, you can complete your profile by adding a cover photo, a profile picture, a description,  acknowledgments, tags, and relevant links.
4. Don’t forget to click “Save” when you’re done.

How to add works to my profile?

You can add a new work from any of the tabs by looking for the “+” symbol, which will appear on the right side of your screen (once you’ve logged in). Click on it, and your works from Safe Creative that you haven’t yet published on Creators will appear.

Select the work or works you want to publish and click continue. In the next tab, you will need to add a description of the works and complete the corresponding data. When finished, don’t forget to click “Save changes”.

How to sell my works on Creators?

You can sell each work in the way you prefer: exclusively to a single buyer, thus transferring all rights; non-exclusively, allowing the buyer to acquire a copy for personal use and enjoyment; or by allowing the buyer to request a quote specifying the characteristics of the license they need.

How to buy works or licenses on Creators?

Anyone or any company can purchase licenses to use works on Creators. To make the payment and acquire the “certificate with the acquired license”, you must register on Safe Creative (for free).

You can directly find the works in their category (Visual, Music, or Literature) that display a fixed price, or those that have an “Open Price”. In the latter case, you can select the use you want to give the work and request a quote.

Once the payment is made in local currency, with a credit card (VISA / Mastercard...), Creators will provide you with the download of the work and the digital certificate of the license. If you choose to acquire the license as an NFT, you must indicate the Metamask digital wallet code where you wish to receive it.  See more
