What is copyright?
These are the powers that the creator of a literary, artistic or scientific work has to claim its authorship and prohibit or authorize any use of it by third parties.
The laws of practically all countries recognize the author a series of rights over her creations. In general, thanks to these rights, the author can decide whether the work is distributed or not, and the conditions under which it can be used, disseminated or modified.
The Bern Convention for the Protection of Literary and Artistic Works (1886)
Collects the provisions that determine the minimum protection that copyright must have.
Its three basic principles are:
- If the author is a citizen of a state that is a signatory to the Berne Convention, his work is protected in all other states.
- The protection of works by copyright is automatic. It does not require compliance with any formalities.
- Copyrights are protected even if in the author's country of origin the laws do not grant protection.
On the other hand, if in the author's country of origin there is a term of protection for his rights that is longer than the minimum prescribed by the Convention (50 years), the term prescribed in the country of origin will have priority.
Moral Rights
Moral rights, with possible variations from one legislation to another, include the right to recognition of the authorship of the work by its creator, the right to decide whether or not it is disclosed the work, the right to decide whether to disclose it under the name of the author or under a pseudonym, respect for the integrity of the work, the right to withdraw the work from commerce, the right of retraction or repentance, the right of access to a single copy...
